Welcome to SiteWhizz. These Terms of Service ("Terms") govern your access to and use of our AI chatbot platform and related services. By accessing or using our services, you agree to be bound by these Terms.

SiteWhizz provides an AI chatbot platform for customer support that allows you to:

  • Create AI chatbots trained on your website content, documents, and knowledge base
  • Deploy chatbots on your website to automate customer support
  • Access analytics and insights about chatbot interactions
  • Customize chatbot appearance and behavior
  • Integrate with third-party tools and services

3. Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 18 years old to create an account and use our services.

4. Acceptable Use

You agree not to use our services to:

5. Payment Terms

Subscription Plans: Our services are offered on a subscription basis. You agree to pay all fees associated with your selected plan.

Billing: Subscriptions are billed in advance on a monthly or annual basis. Your subscription will automatically renew unless cancelled.

Refunds: We offer a 7-day money-back guarantee for new subscriptions. After this period, fees are non-refundable except as required by law.

Price Changes: We may modify our pricing with 30 days' notice. Continued use after the change constitutes acceptance of the new pricing.

6. Intellectual Property

Our Property: SiteWhizz and its licensors retain all rights to the platform, including software, designs, trademarks, and documentation.

Your License: We grant you a limited, non-exclusive, non-transferable license to use our services in accordance with these Terms.

Feedback: Any feedback or suggestions you provide may be used by us without obligation to you.

7. User Content

Ownership: You retain ownership of all content you provide to train your AI chatbot, including website content, documents, and other materials ("User Content").

License: You grant us a license to use your User Content solely for the purpose of providing our services to you, including training and operating your AI chatbot.

Responsibility: You are responsible for ensuring you have the right to use and share all User Content and that it complies with applicable laws.

8. Termination

By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account if you violate these Terms or engage in conduct that harms us or other users.

Effect: Upon termination, your right to use our services ends immediately. We may delete your data after a reasonable retention period.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

While our AI chatbots strive to provide accurate information, they may occasionally produce incorrect or incomplete responses. You are responsible for verifying the accuracy of chatbot responses.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITEWHIZZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.
